This might be a dumb question, but would a guy like Brady Aiken be available to draft this year? I know he was drafted this year, but he did not sign a contract with his real life team that drafted him. Hmmm... I guess my real question should be if the player is drafted but his real life MLB team does not come to terms and sign him, is he eligible to be drafted here?

No, he has to be signed by a MLB team. Now in another league similar to this, the commish creates a list of international players that would be likely to sign soon. I don't know if this would be the same here. However this would be the only exception to the rule.
